TERMS & CONDITIONS
THE LOYALTY PROGRAM “TAM SON ELITE CLUB”
Effective date: 15 Sep 2024
1. INTRODUCTION
1.1. The loyalty program “Tam Son Elite Club” (“Program”) is operated by Tam Son International Joint Stock Company (hereinafter referred to as “Tam Son”) with the purpose of showing gratitude and giving members exclusive privileges from Tam Son, Openasia Group (Openasia Joint Stock Company and its subsidiaries and affiliates), as well as Tam Son’s strategic partners.
1.2. As members of Tam Son Elite Club, Customers commit to read, understand and agree to be bound by the Terms & Conditions of the loyalty program, the terms of Privacy Policy and the Terms & Conditions of Tam Son’s website.
1.3. Tam Son reserves the right to adjust the Terms and Conditions of the Program from time to time. The amendments take an immediate effect and will be informed on the website www.tamsonvn.com. It is suggested that Customers regularly check the Terms and Conditions for the latest updates. That Customers are still members after the Terms and Conditions are updated constitutes acceptance to be bound by the amended Terms and Conditions.
2. CONDITIONS FOR PARTICIPATION
2.1. To join the program, customers must meet the following criteria:
a) 18 years old or older; and
b) provides valid and accurate personal information, (including but not limited to Name, Gender, Nationality, Date of Birth, Phone number, Email and Address); and
c) makes a purchase at stores or e-commerce websites of Tam Son’s officially distributed brands. Any purchases made via e-commerce sites managed by third parties, including but not limited to Shopee, Lazada, Tiki, etc. is considered ineligible.
2.2. Customers agree and commit not to impersonate any other individuals or entities or supply false or misleading information about the Customers’ relationship with other individuals or entities.
2.3. Tam Son’s business partners, suppliers, and employees as well as Openasia Group are ineligible for the membership and will not be entitled to member benefits.
3. MEMBERSHIP TIER
Tam Son Elite Club has 5 tiers including Member, Silver, Gold, Diamond and Elite. As outlined in clause 3.2, the membership tier is determined based on the total spend of qualified Customers within a 365-day membership period. The first period starts from the date Customers join the Program and the subsequent periods start after the end date of the previous periods.
3.1. UPGRADING & MAINTAINING CONDITION
3.1.1. As outlined in clause 2.1, any Customer who is eligible and agrees to join the Program becomes a member with the membership tier assessed as below:

3.1.2. Upgrading condition: Whenever the Customers’ spend within 365 days reaches a new threshold, the membership tier will automatically be upgraded to a next level within a maximum of 24 hours.
3.1.3. Maintaining condition: At the end of a 365-day membership period starting from the date of first purchase or the most recent upgrade, the new tier will be assessed based on the Customers’ spend as follows:
a) If Customers reach the threshold to maintain the current tier, it will be renewed;
b) If Customers cannot reach the threshold, a new tier will be granted corresponding to the Customers’ spend.
3.1.4. Tam Sơn reserves the right, at any time and at its sole discretion, to change the required spending for tier upgrades, tier maintenance, the membership tiers themselves, and any associated benefits. These changes apply to all membership levels.
3.2. ELIGIBLE PURCHASES
3.2.1. To be considered eligible, purchases must meet all of the following criteria:
a) Made at Tam Sơn-owned stores or e-commerce sites featuring Tam Sơn’s officially distributed brands;
b) Linked to the customer’s account (by providing a phone number in-store or logging into the account online;
c) Not returned or canceled;
d) Free from any indications of fraud;
e) Purchases using internal discount policies for Tam Sơn or Openasia Group employees, or special purchase agreements for suppliers and business partners, are not eligible.
3.2.2. Tam Sơn reserves the right to block, cancel, or modify any transaction suspected of fraud, deceit, or legal violations, at its sole discretion.
4. MEMBERSHIP PRIVILEGES
4.1. Each membership tier has different benefits including gifts or coupons depending on the Program’s policy, specifically:

- Coupons are sent to Customers via SMS or email provided by Customers. Coupons are applied with terms and conditions.
- Premium brand group: Bang & Olufsen, Tory Burch, Kenzo, Maison Kitsuné, BOSS, HUGO, Lancel, Marc Jacobs, Longchamp, Sandro, Maje, FairLiar, acmé de la vie, Okaidi-Obaibi, Diptyque, Devialet, Alessi, Hanoia and other brands
- Luxury brand group: Bottega Veneta, Loewe, Rimowa, Lalique, Bernardaud, Christofle and other brands updated by Tam Son
4.2. Membership privileges and incentives specified in Article 4.1 above are not convertible to cash and cannot be transferred.
4.3. The benefits and privileges mentioned in Article 4.1 are subject to availability and may vary over time. Certain benefits may not be accessible in regions outside of Vietnam, even if not explicitly stated in the descriptions.
5. OTHER INFORMATION
5.1. Customers confirm that all personal information provided to Tam Son to join the Program is valid. Tam Son will not be responsible for resolving any complaints about Customers not receiving benefits from the Program due to invalid information.
5.2. Customers authorize Tam Son to use personal information for data analysis and communication purposes by direct mail, email, phone call, or SMS to update promotions and/or new loyalty program-related changes.

5.4. Other terms and conditions of the Program, including but not limited to privacy, use of services, copyright and intellectual property rights, limitation of liability, governing law and dispute resolution, data collection are implemented in accordance with the Terms & Conditions of using the website, the Privacy Policy stated on Tam Son website and the law of Vietnam.
5.5. Tam Sơn has sole discretion in interpreting these Loyalty Program Terms and Conditions, and the company’s decisions are final. In case of any conflict between the Vietnamese version and any of its the ttranslation, the Vietnamese version will prevail.
